Legal with restrictions
Nicotine and vape products are legal to sell, possess, and use in Alaska for adults, subject to youth-access rules (state statutory minimum age 19; overriding federal Tobacco 21 minimum age 21), per-location retailer license endorsements, controlled-access sale requirements, and a statewide ban on vaping in enclosed public places and workplaces. Alaska imposes no state excise tax on vapor products (a 2026 bill creating one and raising the state age to 21 was vetoed on June 18, 2026), but several municipalities tax and regulate them locally, and the Alaska Attorney General is actively treating the sale of FDA-unauthorized e-cigarette and nicotine products as a state consumer-protection violation.
